In the case of a credit institution in the EU, proof to the supervisory authority when applying for a license that it has a certain amount of own funds (currently EUR 5 million). The legal source is Article 9 of Directive 2006/48/EC of the European Parliament and of the Council of 14 June 2006 relating to the taking up and pursuit of the business of credit institutions (recast).
